The lawsuit was filed by Sharon D., a woman from Oak Forest, Illinois who was injured by the VenaTech® Inferior Vena Cava Filter (“IVC Filter”) manufactured by B. Braun Medical Inc.
The IVC Filter was implanted on October 16, 2015 by Dr. Riad Salem at Northwestern Memorial Hospital in Chicago, Illinois. The filter was represented to be safe for permanent placement.
About 4 months later, on February 25, 2016, she underwent a medical procedure to remove the IVC Filter because it had migrated to her heart.
The procedure was performed by Dr. Robert J. Marsh at Rush University Medical Center. At that time, doctors attempted to remove blood clots in her heart, but part of the clots could not be removed.
On May 9, 2016, she passed away as a result of metastatic lung cancer, according to the lawsuit:
The failure of the Vena Tech filter is attributable in part to the fact that the Braun permanent IVC filters, including the Vena Tech filter, suffer from a design defect causing the filters to be unable to withstand the normal anatomical and physiological loading cycles exerted in vivo.”
The lawsuit was filed on February 27, 2017 in the Philadelphia County Court of Common Pleas — Case ID: 180202664.
There are now over 7,000 other IVC filter lawsuits against B. Braun, Rex Medical, Argon Medical, Cook Medical, C.R. Bard, and other manufacturers in state and federal courtrooms nationwide.
